Hizanat
In Pakistan and many parts of Asia, custody of young children is often awarded to the mother under the principle of Hizanat. Under this arrangement, the mother is generally granted custody of a son until a certain age, after which custody may be reconsidered in accordance with the law and the child’s best interests. For a daughter, custody is typically granted to the mother until she reaches puberty, subject to court approval and welfare considerations.
These matters are decided by the court primarily on the basis of the child’s welfare. If the court finds any serious concerns regarding the mother’s character or conduct, custody may be transferred to the father. In certain situations, depending on the circumstances and the best interest of the child, custody may also be granted to the grandparents or other suitable guardians as determined by the court.
In the present era, with the increasing number of divorce cases, child custody disputes have also become more common. Over recent decades, especially among middle and lower-middle-class families, the rate of separation has significantly increased, which has directly led to a rise in custody-related litigation. As a result of parental separation, children often experience emotional, psychological, and social difficulties that can have long-lasting negative effects on their development.
In Pakistan and several other Asian jurisdictions, custody and guardianship matters are primarily governed by the Guardians and Wards Act, 1890. Under this law, the welfare and best interest of the child is the foremost consideration for the guardian court when deciding custody matters.
The legal rights of parents in relation to custody and guardianship are addressed under Sections 17 and 25 of the Guardians and Wards Act, 1890. These provisions are commonly associated with the principles of Hizanat and Wilayat, which guide the court in determining custody arrangements in accordance with the child’s welfare.
If custody is awarded to the father, it is referred to as Wilayat. However, Hizanat and Wilayat are not strictly limited to mother and father alone, as custody or guardianship may also be granted to other close relatives such as grandmothers or aunts, provided they are legally eligible and deemed suitable by the court.
It is also important to understand that when a son reaches a certain age, custody does not automatically transfer to the father. In such cases, the father must separately apply to the court for custody, and the matter is decided based on legal proceedings and the welfare of the child.
