Validity of Shara’i Nikah in Pakistan

Shara’i Nikah is fully valid under Islamic law, as it fulfills the essential religious requirements of marriage. However, in Pakistan, registration of the marriage is important to ensure legal recognition and to facilitate the enforcement of the spouses’ legal rights under the law.

A Shara’i Nikah may be performed anywhere in Pakistan, including Islamabad, Rawalpindi, Lahore, Multan, Faisalabad, and other cities, as well as in other countries. However, to avoid legal complications and to establish documentary proof of the marriage, it is strongly recommended that the Nikah be properly registered with the relevant authorities.

The Procedure of Shara’i Nikah

Shara’i Nikah is solemnized through Ijab-o-Qabool (offer and acceptance) between the bride and groom in the presence of competent witnesses, with the agreed Mahr (dower). Once these essential Islamic requirements are fulfilled, the marriage is considered valid under Islamic law.

Unlike a civil marriage, a Shara’i Nikah is a religious ceremony and, by itself, does not involve formal legal registration. Although the Nikah is typically documented by completing and signing an Urdu or English Nikah Nama by the bride, groom, witnesses, and Nikah Khawan, official registration is strongly recommended to ensure legal recognition and to protect the rights of both spouses under Pakistani law.

A civil marriage, on the other hand, is completed in accordance with applicable legal procedures and is officially registered with the relevant authorities. Proper registration provides documentary evidence of the marriage and facilitates the enforcement of legal rights relating to inheritance, maintenance, child custody, and other family matters.
