Types of Divorce

Divorce is generally classified into three main types:

Talaq

This type of divorce is initiated by the husband, who has the legal right to dissolve the marriage through talaq. Talaq may be given orally, in written form, or through electronic communication. In practice, the process involves three pronouncements of talaq, each separated by a prescribed time period, to complete the dissolution of marriage.

Khula

Khula is the legal right of a wife to seek dissolution of marriage. It is initiated by the wife through legal proceedings. In most cases, khula is accompanied by claims relating to dowry articles and, where applicable, child maintenance. The process is carried out through a lawyer before the court in accordance with applicable family laws.

Divorce Through Mutual Consent

A marriage may be dissolved by mutual agreement of both spouses. In such cases, the settlement should be properly documented, often on stamp paper, to ensure legal validity. Both parties are free to mutually decide the terms and conditions of the separation in accordance with their agreement.

Procedure for Divorce or Khula

A divorce or khula case can be filed by a woman in any Family Court across Pakistan, and she has the legal right to initiate proceedings in any relevant jurisdiction. For proper filing and to ensure that her rights are fully protected, the assistance of an experienced family lawyer is essential.
